Just as all restaurants do not serve sushi, not all attorneys write Wills or handle estate planning. You need to find a qualified attorney, hopefully one who specializes in Wills and related estate and tax planning. I am certified by the Texas Board of Legal Specialization in Estate Planning and Probate Law. I am also a member of the American College of Trust and Estate Counsel.
There is one question I can answer for any client or prospective client with some certainty. Even if I do not know what your "order" will be, I can tell you what it costs not to write a Will. It will likely cost your beneficiaries more in Court costs and legal fees: if the Court is involved in settling your affairs, an attorney will have to be involved in all aspects of that process. It is likely to cost your beneficiaries more in death taxes and management fees. These are costs to your beneficiaries, not to you.
What not having a Will may cost you is the security of knowing that the family, friends and charities to whom you want to leave your assets actually receive them. Without a Will, the state law makes one up for you. The only problem is that state law may not name the beneficiaries you want to name. The "state law Will" may include relatives you would never include. If your child dies without a Will after you, even your ex-spouse may become a beneficiary of your property that was left to your child. The "state law Will" will not include the friends or charities that you want to remember. So, state law will write a Will for you, if you do not write your own. But, that is like having the owner of the restaurant place your "order" for you.
